These Terms of Service (the "Terms") set out the conditions for use of "Pro.VISION JAPAN オンラインショップ" (the "Service") operated by Pro.D LLC (the "Company"). Please use the Service only after agreeing to these Terms.

Article 1 (Application)

These Terms apply to all relationships between the Company and users concerning use of the Service. Individual provisions and notices separately established by the Company on the Service form part of these Terms.

Article 2 (Definitions)

  • "Member" means a user who has agreed to these Terms and completed membership registration by the prescribed method.
  • "Purchaser" means a user who has carried out a purchase through the Service.

Article 3 (Membership Registration)

  1. Use of certain features of the Service requires membership registration. Applicants shall register true and accurate information.
  2. The Company may decline to approve registration where the applicant has previously breached these Terms, or where the Company otherwise deems it inappropriate.
  3. Where the Company determines that registration information is false or improper, it may cancel the registration without prior notice.

Article 4 (Account Management)

  1. Members shall, at their own responsibility, appropriately manage their email address, password, two-factor authentication information, and the like.
  2. The Company may treat acts performed using the registration information as acts of the relevant member. The Company is not liable for damage arising from inadequate account management or use by a third party.

Article 5 (Purchases)

  1. The Purchaser carries out a purchase through the prescribed procedure on the Service. The contract for a purchase is formed by the method established by the Company.
  2. The content, price, quantity, and conditions of provision of each product are as displayed on the relevant pages of the Service. Unless otherwise stated, displayed prices are tax-included amounts (consumption tax included).

Article 6 (Payment)

  1. Payment shall be made by credit card or other methods established by the Company on the Service.
  2. When paying by credit card, the Purchaser must be able to complete the card issuer's prescribed identity authentication (EMV 3-D Secure). Where such authentication cannot be completed, we may be unable to accept a purchase.
  3. Card information is handled securely by the payment service provider and is not retained on the Company's servers.

Article 7 (Delivery and Shipping of the product)

  1. The delivery timing, shipping method, and shipping fees for the product are as displayed on the relevant pages of the Service (such as the "Notation Based on the Specified Commercial Transactions Act" and "About Shipping").
  2. For made-to-order and semi-order products, a reasonable period may be required before delivery because production time is involved.

Article 8 (Returns, Cancellation, and Exchanges)

Whether returns, cancellation, and exchanges are available, and the applicable conditions, are governed by the "Notation Based on the Specified Commercial Transactions Act" and other individual pages on the Service. Returns for the Purchaser's own convenience are, in principle, not accepted (excluding defective or incorrectly shipped items).

Article 9 (Prohibited Acts)

In using the Service, users must not engage in any of the following acts.

  • Acts that violate laws and regulations or public order and morals
  • Acts that infringe the rights of the Company, other users, or third parties
  • Unauthorized access, impersonation, unauthorized use of another person's account or credit card, or acts by improper means such as credit master attacks
  • Acts that interfere with the operation of the Service, or that impose an excessive load (such as mass access using automated tools)
  • Purchasing for the purpose of resale or for any other improper purpose
  • Other acts that the Company deems inappropriate

Article 10 (Suspension of the Service and Cancellation of Membership)

Where a user breaches these Terms, or where there is a suspicion of improper use, the Company may, without prior notice, take measures such as suspending the user's use of the Service, cancelling membership, or cancelling transactions.

Article 11 (Disclaimer)

  1. The Company makes no warranty, whether express or implied, that the Service is free from de facto or legal defects.
  2. Except in cases of the Company's willful misconduct or gross negligence, the Company is not liable for any damage incurred by a user due to interruption, suspension, or termination of the Service, loss of data, or the like.

Article 12 (Intellectual Property Rights)

Copyrights, trademark rights, and other intellectual property rights relating to the Service belong to the Company or to the rightful holders. Users must not use them without the Company's permission.

Article 13 (Handling of Personal Information)

The Company handles users' personal information appropriately in accordance with the separately established "Privacy Policy."

Article 14 (Changes to These Terms)

The Company may change these Terms without notice to users where it deems necessary. The changed Terms take effect from the time they are displayed on the Service.

Article 15 (Governing Law and Jurisdiction)

These Terms shall be governed by and construed in accordance with the laws of Japan. In the event of any dispute relating to the Service, the Fukuoka District Court shall be the court of exclusive agreed jurisdiction for the first instance.
